Welcome to DIDI.BIKE. These Terms of Service ("Terms") govern your use of our cycling telemetry sensors, software, and services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

1.1 Agreement to Terms

By purchasing, installing, or using DIDI.BIKE products and services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1.2 Age Requirement

You must be at least 13 years old to use DIDI.BIKE services. By using our services, you represent and warrant that you meet this age requirement.

2. Products and Services

2.1 DIDI.BIKE Sensor

DIDI.BIKE Sensor is a precision cycling telemetry hardware device that measures biomechanics, aerodynamics, and performance metrics. The sensor collects and transmits data to compatible cycling computers and mobile applications via ANT+ and Bluetooth Low Energy protocols.

2.2 Software and Firmware

We provide software applications and firmware updates for the DIDI.BIKE Sensor. These are protected by intellectual property laws and may not be reproduced, modified, or distributed without our prior written consent.

2.3 Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access to our services. Maintenance windows and service interruptions will be communicated to registered users in advance when possible.

3. User Responsibilities

3.1 Proper Use

You agree to use DIDI.BIKE products and services in accordance with:

• All applicable laws and regulations
• Manufacturer guidelines and safety instructions
• Local traffic laws when cycling
• Bicycle safety standards and best practices

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• Activities that occur under your account
• Notifying us immediately of any unauthorized access

We are not liable for any loss or damage arising from your failure to comply with these security obligations.

3.3 Prohibited Uses

You may not use DIDI.BIKE products or services for:

• Any illegal purpose or in violation of applicable laws
• Reverse engineering, decompiling, or attempting to extract source code
• Removing or altering any proprietary notices or labels
• Interfering with or disrupting our services or servers
• Distributing malware or malicious code through our platforms
• Competitive analysis or benchmarking without express permission

4. Intellectual Property

4.1 Ownership

All content, features, and functionality of DIDI.BIKE products and services are owned by DIDI.BIKE and protected by intellectual property laws, including but not limited to copyrights, trademarks, patents, and trade secrets.

4.2 License Grant

We grant you a limited, non-exclusive, non-transferable license to use DIDI.BIKE products and services for personal or authorized commercial use in accordance with these Terms.

4.3 Feedback

Any feedback, suggestions, or ideas you provide regarding DIDI.BIKE products or services become our property. You assign all rights, title, and interest in such feedback to us.

5. Warranty and Limitation of Liability

5.1 Product Warranty

DIDI.BIKE Sensor is covered by a 2-year limited hardware warranty from the date of purchase. The warranty covers manufacturing defects under normal use conditions. The warranty does not cover:

• Normal wear and tear
• Damage from misuse, abuse, or accidents
• Unauthorized modifications or repairs
• Water damage exceeding IP67 protection specifications
• Loss or theft

5.2 Disclaimer of Warranties

Except as expressly stated in the limited warranty, DIDI.BIKE products and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to:

• Implied warranties of merchantability
• Implied warranties of fitness for a particular purpose
• Non-infringement of third-party rights

5.3 Limitation of Liability

To the maximum extent permitted by applicable law, DIDI.BIKE shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or business opportunities
• Personal injury or property damage resulting from cycling activities
• Third-party actions or inactions

5.4 Maximum Liability

Our total liability to you for all claims shall not exceed the amount you paid for the specific product or service giving rise to the claim.

6. Data and Analytics

6.1 Data Accuracy

While DIDI.BIKE Sensor is designed for high precision, we do not guarantee absolute accuracy of all measurements. Biomechanics and aerodynamics data should be used for reference and training purposes, not for critical safety decisions.

6.2 Third-Party Integrations

DIDI.BIKE enables integration with third-party platforms such as Strava, TrainingPeaks, Garmin Connect, and others. We are not responsible for:

• The privacy practices or terms of service of third-party platforms
• The availability or functionality of third-party services
• Data processing or storage by third-party providers

7. Privacy

Your use of DIDI.BIKE products and services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of information as described in our Privacy Policy.

8. Termination

8.1 Termination by User

You may terminate your account and stop using DIDI.BIKE services at any time by:

• Contacting our customer support team
• Deleting your account through your dashboard
• Uninstalling sensor firmware and applications

8.2 Termination by DIDI.BIKE

We reserve the right to suspend or terminate your access to DIDI.BIKE services at any time, with or without cause, with or without notice, for any reason, including but not limited to:

• Breach of these Terms
• Suspected fraudulent or illegal activity
• Extended period of inactivity
• Technical or security reasons
• Discontinuation of service

8.3 Effect of Termination

Upon termination, your right to use DIDI.BIKE products and services will immediately cease. We may delete your account data in accordance with our Privacy Policy, except where required by law to retain certain information.

9. Indemnification

You agree to indemnify, defend, and hold harmless DIDI.BIKE, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of DIDI.BIKE products and services
• Your violation of these Terms
• Your violation of any third-party rights

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.

10.2 Arbitration

Any dispute arising from or relating to these Terms or your use of DIDI.BIKE products and services shall be resolved through binding arbitration in accordance with the rules of the China International Economic and Trade Arbitration Commission (CIETAC).

10.3 Class Action Waiver

You agree to resolve any disputes on an individual basis and waive any right to participate in class actions or class-wide arbitrations.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Emailing registered users at least 30 days before changes take effect
• Posting a prominent notice on our website
• Notifying you through the DIDI.BIKE mobile application

Continued use of DIDI.BIKE services after modifications constitutes acceptance of the updated Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and DIDI.BIKE regarding your use of our products and services. These Terms supersede any prior agreements or communications between you and DIDI.BIKE.

14. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless in writing and signed by an authorized representative of DIDI.BIKE.
